Terms and Conditions of Purchase

Definitions

In these Terms and Conditions, the following words and phrases shall have the following meaning:

We“, or “Our“, or “Us” shall mean Solihull Residential Lettings whose registered office address is at Malvern House New Road Solihull West Midlands B91 3DL and its successors in title and assigns.

You“, or “Your” shall mean anyone owning an interest in the Property (whether freehold or leasehold) entitling them to possession upon the termination or expiry of the Tenancy Agreement and thus subsequently owns the Property in accordance with the Land Registry. It may also include anyone acting as the Landlord’s agent.

Sign Boards

We will ensure the sign board is erected appropriately although we cannot guarantee it will remain in situ.

The board remain the property of Solihull Residential Lettings and it is the customers responsibility to ensure it remains on site and can be retrieved.

Loss of the board is chargeable at £100

Professional Photographs

These will be taken in one session only.

Whilst we welcome your involvement, we reserve the right to approve the final suite of images and the right to use them for advertising purposes.

Reference Applicants

We cannot guarantee that an applicant, despite passing referencing, will perform their contractual and legal obligations throughout the tenancy.

It remains the Landlords responsibility to decide whether, based on the information available after referencing, they wish to rent their property to the applicant.

Prepare Tenancy Agreement and facilitate electronic signing

We will ensure that the tenancy agreement is sent to the signatories by DocuSign although we cannot guarantee they will review and sign the document.

Prepare Deed of Guarantee and facilitate electronic signing

We will ensure that the deed of guarantee is sent to the signatories by DocuSign although we cannot guarantee they will review and sign the document.

Offer Prescribed Information and facilitate electronic signing

We will ensure that the prescribed information is sent to the signatories by DocuSign although we cannot guarantee they will review and sign the document.

Offer How to Rent CP12 and EPC and facilitate electronic signing

We will ensure that the How to Rent CP12 and EPC documents are sent to the signatories by DocuSign although we cannot guarantee they will review and sign the documents.

 Ensure Right to Rent verification is satisfied at the beginning of the Term

We cannot monitor changes in status of a tenants right to rent after the tenancy begins.

This remains the Landlords sole obligation.

Register deposit with Deposit Protection Service

The deposit can only be transferred from our account to yours once we have received your Deposit Protection Service registration details.

If you fail to provide us with this within 1 month we will charge you a handling fee of £20 including VAT per month.

Complete and serve form 6A

We will serve this document within the timeframe allowed.

Please note that its expiry does not represent the date the tenant has to leave, rather the earliest date you can request a court order for possession.

Complete and serve Section 8 Notice

We will serve this document within the timeframe allowed.

Please note that if on mandatory or discretionary grounds we cannot guarantee the tenancy will be terminated when the matter is brought before a judge.

Complete and serve form 13

We will serve this document within the timeframe allowed.

Please note that the Tenant may challenge or refuse to pay the increase.

We accept not liability if this happends.

Management Assistance

The advice we provide is based on best practice and managerial experience.

Any legal opinion is sourced from specialist lawyers and is relayed to you in good faith.

We cannot guarantee that your interpretation is the same as ours and recommend you engage specialist lawyers directly should you need to and at your own expense.

Prepare Photographic Index

Whilst we agree to take a minimum of 100 dated images, we cannot guarantee their scope.

Midterm professional inspection of condition

Whilst we endeavour to create an accurate detailed report taking a minimum of 5 dated images, we cannot be liable for unintended omissions.

Guidance and support on reasonable expectations of property return

Guidance and support are generic and certain aspects may not apply to your property.

Guidance and support on managing disputes

Guidance and support are based on managerial procedures and experience.

They should not be construed as having a legal basis.

We accept no guarantee that you will be successful in your claim.

Attend and facilitate bailiff eviction

We reserve the right to decline attendance based on the results of risk assessment.

Should this be the case we will make a full refund to you within 7 days subject to you making your bank details available to us.

Rent Indemnity and Legal Protection Service

We cannot be held liable for your failure to comply with the timebound request for documents required by the underwriters.
